Recapture Clause

A lease right letting the landlord terminate the lease and take back the space, typically when the tenant goes dark or tries to assign or sublet.

A recapture clause gives the landlord the right to end the lease and reclaim the premises under certain conditions, most often when the tenant stops operating for a set period or requests consent to assign or sublet. Recapture lets the landlord re-lease a dark or underused building rather than wait out the term. Leases specify notice periods, whether the tenant can cure by reopening, and whether the landlord owes any payment.
